Cybercrimes Bill that much closer to becoming an Act

The National Council of Provinces has amended the Cybercrimes Bill again and sent it to the President for approval. In general all the amendments to the Cybercrimes Bill were passed by majority vote. Some of the more significant amendments include: 

  • Section 20 - orders to protect victims pending the finalisation of criminal proceedings, 
  • Section 21 - provide for information from electronic communications service providers, 
  • Section 24 - jurisdiction: if the offence 'affects' any person in the Republic then South Africa has jurisdiction
  • Section 32 - ability for a police officer to search without a warrant 

There are several other amendments to other laws, particularly the Criminal Law (Sexual Offences and Related Matters) Amendment Act of 2007 which are worth noting.
